- Customers refers to the users who purchase tickets to access the streamed content on Tikstream.
- Site refers to the Tikstream website and service.
Tikstream is a service available to people 13 years old and over. If the event is not suitable for children or teenagers, this needs to be specified in the event details. Tikstream will not be held responsible for inappropriate content being presented by host organisations. Tikstream does not control the content provided or presented by host organisations.Broadcast rights and copyright
All broadcasting licensing and copyright is the responsibility of the performing host organisation. You warrant that you have rights to present the content to an online audience when using Tikstream. You use Tikstream at your own risk and accept that Tikstream cannot guarantee that customers or others will not record or copy the content presented, despite Tikstream efforts to prevent this. You affirm that you are the creator and owner of and/or have the necessary licenses, rights, consents, releases and permissions for any content that you present on Tikstream.Prohibited content
Host organisations will not present unlawful content, false or misleading content, or content with malicious intent (eg. distribution of malware).Customer relations
Your brand will be represented by Tikstream and the customer relationship is primarily between the host organisation and the customer. Tikstream acts as the facilitator of this connection. It is important that the quality of your content and the streamed event that you provide will meet your customer’s expectations. Tikstream will not be held responsible for any dissatisfaction with the content presented. All customer support requests will need to be managed by the host organisation. Tikstream will endeavour to support host organisations to troubleshoot customer issues, within reasonable expectations and response times but cannot guarantee immediate rectification of issues.Customer experience
The customer experience of Tikstream is intended to be smooth and seamless, however end-user performance will be contingent upon individual internet connection speeds.
In the event that the service fails due to poor connection, Tikstream will not be held responsible. The material on Tikstream is provided as is and without warranty of any kind, either express or implied. To the fullest extent possible under applicable law, Tikstream disclaims all warranties, express or implied. Tikstream does not warrant that the function performed on the site will be uninterrupted or error free, that defects will be corrected or that this site, including its servers and software are free of viruses or harmful components.Recording and presenting content
The host organisation is responsible for recording all audio and video content for presentation via the live or pre-recorded stream. Tikstream will endeavour to provide guidance on the optimal content production, however the quality of the production is the responsibility of the host organisation. The host organisation agrees to ensure that the presentation of the streamed content occurs at the ticketed event time and date, or not more than 30 minutes after the starting time. In the event of unforeseen delays to live streaming service, the host organisation should notify Tikstream and its customers of the expected delay.Customer refunds
In the event that a live-streamed event is cancelled and must be refunded, the refunds will be managed by the host organisation. Fees collected by Tikstream (including payment gateway and service transaction fees) will not be refundable by Tikstream.Customer data
It is the responsibility of the host organisation to manage donations and receipts for donations according to the appropriate local laws and regulations. The onus is on the host organisation to communicate with customers how any donation funds will be put to use. Donation amounts are calculated based on the total price nominated by the customer for the ticket purchase, less the base ticket price, less the transaction fee. All prices include GST.Payment terms
Tikstream collects a transaction fee based on the volume of tickets sold to live or pre-recorded streamed events. This transaction fee will be stipulated in the service agreement between Tikstream and the host organisation. Fees will be calculated and invoiced on a monthly basis and paid within 14 days unless agreed otherwise in writing. Host organisations may be required to pay a set up cost before events and ticket sales can commence.Third parties
The website and its contents and features (including information, software, images, content, video, audio, designs and code) are owned by Studio Bravo Pty Ltd trading as Tikstream. This is protected by copyright and intellectual property laws.
Your use of this service is governed by the relevant local and federal laws. You are expected to comply with these laws.Change of terms
Tikstream reserves the right to change these terms at any time. All changes are effective at the time of posting them on this page. In continuing to use the service, you accept the terms at the time of use. It is your responsibility to check these terms periodically to stay up to date.
